One: Special Note
Here we are glad to remind you (user) that before you purchase the service, please read carefully this 《Service Purchase Rules Agreement》 (Hereinafter referred to as the "Agreement") to ensure you can fully understand all clauses listed in the Agreement. Please you carefully read and choose whether you accept the Agreement or not. After you agree and confirm the Agreement and finished the purchase, then you can enjoy the service. Your purchase is deemed to accept the Agreement and also means you agree to be bound by the terms of this Agreement. If you DO NOT agree to the Agreement, or there is any doubt about the terms of the Agreement, then please stop purchase immediately and quit purchase interface.
This Agreement sets forth the rights and obligations between Seer Health and the User with respect to the "Purchase" service (hereinafter referred to as the "Service"). The “User” means the person or unit who registration, log in and use Seer Health. This Agreement may vary by Seer Health and the updated Agreement will replace previous Agreement once it is released without further notice. The User can check the details of updated Agreement in APP. After the Agreement is updated, if the User DO NOT accept the updated Agreement, please stop the Service of Seer health immediately and the User will be deemed to accept the updated Agreement if continue to use the Service of Seer Health.
Two: Account Security
1、The Users can prove that they have registered the account of Seer Health through using service purchase function and guarantee themselves perform the purchase operation.
2、The Users are fully responsible for their own account name and password and also fully undertakes liability for all behaviors and events through their account name.
3、The Users are prohibited to give assignment or authorization of Seer Health account in any form to others.
4、The Users have the responsibility to keep the password safe and DO NOT show it to any other person. The Users will undertake full liability for any loss caused by bad password keeping.
5、If there is any possible adverse legal consequences due to password disclosure, which for whatever reason would result in the User’s password is under danger, then please contact our customer service immediately. Otherwise, all is on the User’s own risk.
Three: Users Declaration and Guarantee
1、The Users give commitment that they are a civil subject who have full capacity for civil conduct and have the ability to conclude transactions to fulfill its obligations.
2、The Users give commitment that the purchase behavior of service is own operation and a sign of true meaning.
3、The Users shall not violate the relevant laws and systems of the state for the behaviors during purchasing, which including but not limited to the following principles:
(1)Violating the basic principles set forth in the Constitution
(2)Divulging state secrets that endanger state security or subvert state power and undermine national unity
(3)Harming the honor and interests of the state
(4)Inciting ethnic hatred or discrimination to undermine ethnic unity
(5)Undermining the state's religious policies and promoting cults and feudal superstitions
(6)Spreading rumors, disturbing social order and undermining social stability
(7)Disseminating obscenity, pornography, gambling, violence, murder and terror or abetting a crime
(8)Insulting or slandering others and infringing upon the lawful rights and interests of others
(9)Containing other contents prohibited by laws or administrative regulations
4、The Users shall not use the "Seer Health" account or the vulnerability of service to illegally infringe Seer Health and other users or the legitimate rights and interests of third parties。
Four: Service Contents
1、The Service Contents is subject to the projects listed by Seer Health. The Users themselves can choose multi-service projects at the same time.
2、The Service Contents is subject to the updates released by Seer Health. The Users agree to the immaterial update or change for their purchased services by Seer Health during the services period.
Five: Service Price
1、Each service price is subject to the real-time page price when the Users purchase and Seer Health will NOT provide any compensations or collections for possible price adjustment (up or down).
2、The period of service is subject to the time displayed on the page of Seer Health.
Six: Termination of Service
1、The Service that the Users purchased will be automatic termination upon expiration. Seer Health will NOT refund money for whatever reason once the Users activate the Service.
2、Seer Health shall reserve the right to terminate the Service and DO NOT refund money if the Users have the behaviors below during using the Service
(1)Seer Health shall reserve the right to terminate the Service if the Users violate the relevant provisions of this service Agreement: For example, the Users register the account again directly or indirectly in someone else’s name, once this behavior is found, Seer Health shall have the right to terminate the Service unilaterally.
(2)The Users are prohibited to hack the system of Seer Health through any program or technical means. Seer Health shall have the right to terminate the service and withhold the account amount once above behaviors are found.
(3)Seer Health shall reserve the right to terminate the service once we found the data or information provided by the Users are fake.
(4)Seer Health shall reserve the right to terminate the service and withhold the account amount, meanwhile, has the obligation to report such behaviors that the Users use our Service for Illegal and criminal activities.
3、When the Service clauses are terminated or updated, which the Users express unwilling new service clauses.
4、And other situations where it is considered necessary to terminate the service.
5、The Users understand and agree, which even if the Agreement and Service for Users are terminated, Seer Health shall still have the right:
(1)Continue to keep the information of the Users
(2)Continue to advocate to the Users about their liability due to the Users against the laws and regulations or this Agreement during they use the service of Seer Health.
Seven: Change and Interruption of Service
1、Seer Health shall reserve the right to amend any content of the Service clauses at any time and will deliver amended contents to the Users through proper ways once there is any change of this service clauses.
2、Seer Health needs to inspect or update the network service platform regularly or irregularly, Seer Health will NOT undertake any liability if there is any possibly reasonable interruption of the service platform upon above inspection or update behaviors.
Eight: Modification of clauses of service
1、In view of the particularity of service, the Users shall agree to the network service that would change, partially or fully interrupt and delete (no more save) the documents that the Users provided during using, which no need to notify and also no need to undertake any liability to any user or third party.
2、The Users shall reserve the right to stop to use the network service if they DO NOT agree to the modification of the service clauses.
3、The Users are deemed to accept the modification of service clauses if they continue to use the service.
Nine: Modification of clauses of service
1、The Users will undertake all consequences caused by faulty operation if Seer Health has expressed the change of service and reminded the Users.
2、The Users expressly agree to undertake all risks during they use. Meanwhile, the Users agree to undertake all consequences and the damage to any other third party caused by breach of any provision of this agreement.
3、The Users agree to protect the interests of themselves and the others and undertake liability for damages to any third party caused by Illegal, untrue, improper, infringement of the legitimate rights behaviors.
Ten: Privacy Statement
1、Range of Application:
(1)The Users shall protect their privacy during using the service.
(2)During the Users use or visit the server of Seer Health, the system receive and save automatically the server data.
2、Use of Information：
(1)Unless obtained the permission from the Users, Seer Health DOES NOT sell or lend the personal information to any other.
(2)Seer Health shall prohibit any third party to gather, edit or spread for free the personal information. Seer Health shall have the right to terminate the service protocol with the Users and frozen the account once Seer Health found any above illegal behaviors.
(3)In order to the aim to serve, Seer Health would provide service through using the personal information, which including but not limited to send service messages, or share the personal information with cooperated partners that allow the partners to send relevant products and service information as well.
3、Information disclosure: The personal information would be disclosed partially or fully under below situations:
(1)Disclose to third party with the Users’ permission
(2)Disclose to third party, administration or judiciary authorities according to relevant provisions of the law, or requirements of administration or judiciary authorities.
(3)Disclose to third party If the Users in violation of the relevant Chinese law or website policy.
(4)Must share with third party for the necessary service that the Users require.
(5)Other disclosures as deemed appropriate by law or website policy.
(6)The bank account information provided by the user when using will strictly comply with the confidentiality agreement.
Eleven: Others
1、Solemnly remind the users’ attention about the clauses of Seer Health liability and restriction of Users’ right in the Agreement. Please read the Agreement carefully and consider the risks independently, especially for the juveniles who must understand the Agreement carefully under the guardians.
2、The resolution of this Agreement for validity, interpretation and dispute shall be governed by the laws of the People's Republic of China. If there is any dispute or controversy among Users, shall be settled friendly agreement first, if consultation fails, the Users should agree to submit the dispute or controversy to the people's court that has jurisdiction where the place of service provider is.
3、If any clause of this Agreement is invalid or unenforceable for whatever reason, but for other clauses that still have the force of law, then the other clauses still remain binding.
4、The right of final interpretation of this agreement belongs to Shaan Xi Seer Health Biotechnology Co., Ltd and Seer Health reserves all rights of interpretation and amendment.
5、This Agreement applies since January 1st, 2020.
The Users confirm to fully read and understand all relevant clauses of this Agreement, totally understand all the meaning of clauses and totally note and agree to legality and validity of all clauses in this Agreement.
Shaanxi Seer Biotechnology Co., Ltd
